Jailed Porsche driver Richard Pusey will make a fresh application for bail after he allegedly posted online images of the police officers killed in the Eastern Freeway crash.

The former mortgage broker has twice been refused bail since February after he allegedly uploaded photos from the April 2020 crash in a Google review of a Porsche dealership and in a complaint to the Australian Financial Complaints Authority.

Pusey, 44, appeared in the Supreme Court on Wednesday via video link from Melbourne Remand Centre, where he was told he needed to resubmit documents for a new bail application to succeed.

In July, a Supreme Court justice found Pusey, who has spent about seven months in custody, failed to meet the exceptional circumstances required for bail and that he posed an unacceptable risk of reoffending if released.

In May, a magistrate also refused bail after accepting police were concerned Pusey could still access the photos he had taken on his phone and that they could be stored on iCloud.

On Wednesday, Judicial Registrar Tim Freeman told the self-representing Pusey, the court was not trying to “thwart” his application but he needed to meet the bail requirements for his new application to succeed.

Pusey, who filed 15 subpoenas and wanted police officers to give evidence at a previous bail hearing, was told he would be given until September 16 to resubmit documents.

“Whilst I appreciate you represent yourself in this matter and don't have the benefit of legal representation, the court has gone to significant length to support you in the best way it can,” Mr Freeman said.

Pusey has pleaded not guilty to two counts each of using a carriage service to cause offence and committing an indictable offence on bail for allegedly distributing graphic pictures of the crash.

That case was last month adjourned in Sunshine Magistrates’ Court and will return on September 28.

He was previously sentenced to 10 months’ jail after being found guilty of outraging public decency by filming the deaths of four police officers in April 2020.

Pusey had been pulled over by police for speeding when a truck veered into the emergency lane and fatally struck the four officers.
