Richard Pusey has been refused bail despite breaking down in tears in court and quoting the “R U OK?” slogan in his push to be freed back into the community.

The former mortgage broker became emotional when representing himself in a bail application before Victoria’s Supreme Court on Friday.

“How’s your mental health? Are you OK today?” Pusey began in his monologue to the court, before reaching for a tissue.

“These slogans are all the time on the television. Are you really OK … what if I’m not?”

Pusey, who caused outrage when he infamously filmed the aftermath of the Eastern Fwy crash that killed four police officers in April 2020, claims his mental health met the exceptional circumstances hurdle to release him on bail.

He says he is not getting the medical treatment he requires while in prison, saying it was even a struggle to just “get a panadol”.

He detailed his “distress” and “frustration”, which he claims was “caused by a rigged and broken system”.

Pusey, 44, has been on remand since February after being charged with several counts of using a carriage service to cause offence by sharing graphic images from the 2020 crash, in which he had been stopped by police for speeding in his Porsche when a passing truck veered into the emergency lane and hit the officers.

Police allege Pusey attached the images to a complaint made to the Australian Financial Complaints Authority (AFCA) in November about his car insurance company rejecting his claim over the damage to his Porsche.

He is also accused of sharing a crash photo in a Google review of Porsche Centre Melbourne on February 7.

He plans to contest the charges in Sunshine Magistrates Court next month, saying his efforts to prepare to defend himself were being hampered by being in custody.

Prosecutor Anthony Albore opposed bail saying Pusey had failed to outline a sufficient mental health plan for treatment if he is released.

He also argued Pusey was an unacceptable risk of further offending, with the main police concern being that he could still access the crash images on his iCloud account and continue to share them.

Mr Albore said AFCA staff were “disturbed” by the images sent to them and accused Pusey of only distributing them for the purpose of causing “offence or a reaction”.

Mr Albore said Pusey did not have a good track record of following court orders, with multiple breaches of bail in the past.

When Justice Lesley Taylor asked if she was to give Pusey his liberty again, whether he would behave himself, he replied: “I would abide by the conditions of bail and I would not commit crime,” he said.

Ultimately, Justice Taylor was not convinced and refused bail.

She told Pusey she was not satisfied he had demonstrated exceptional circumstances.

Even if she had been of a different view, she said, the prosecution’s evidence highlighted he was an unacceptable risk of endangering the safety or welfare of any person and committing an offence while on bail.
