A Mongols sergeant-at-arms has been jailed over a “terrifying” daylight shooting on a South Morang street that almost claimed a life.
Robbie Hurmiz, 24, and co-accused Tristan Workman and Gabriel Verigos were out for revenge on July 20, 2022, when they ambushed a former friend who had started sleeping with Workman’s ex-girlfriend.
Shocking CCTV footage, released by the County Court on Friday, captured the moment the trio pull up in a silver Toyota and pounce on the 21-year-old man.
While Workman tries to drag the victim out of his gold Ford, Hurmiz fires two shots at the car.
One bullet travels through the window and hits the steering wheel, narrowly missing the man, while the other grazes Workman’s cheek.
The 21-year-old runs for cover before returning to put Workman in a headlock.
But he was outnumbered.
Workman, 23, and Verigos, 19, violently attack the man by punching, kicking and stomping on him as he tries to defend himself.
Verigos, who was a Mongols prospect, brandishes a sawn-off gun during the bashing.
Meanwhile, Hurmiz sits in the driver’s seat of the silver Toyota and aims his high-powered gun at the man but does not shoot.
Before fleeing, Workman uses a screwdriver to slash his tyres.
The trio was sentenced in the County Court last week after admitting to the attack in August.
Hurmiz pleaded guilty to discharging a firearm with reckless disregard for safety, being armed with criminal intent and common law assault, while Verigos and Workman pleaded guilty to being armed with criminal intent and common law assault.
Verigos also admitted to dangerous driving causing serious injury and failing to render assistance, after running a red light and crashing into a car while high on meth in March 2022.
During a pre-sentence hearing, Hurmiz’s defence lawyer told the court his client only intended to frighten the victim, not shoot him.
But Judge Arushan Pillay said his behaviour on a suburban street of Melbourne was nevertheless “terrifying”.
“You took the deliberate decision to fire and discharged at least two shots in close proximity to (the victim) and also Workman,” he said.
“It is true that you are charged with a reckless disregard for the safety of the victim, as opposed to actual intent to harm.
“However, it is an example of brazen, reckless behaviour, with potentially dire consequences, to discharge a firearm, not once, but twice, in such close proximity to both (the victim) and Workman.”
While two of the offenders were associated with the Mongols, Judge Pillay noted there was no relationship between the outlaw motorcycle gang and the offending.
But he condemned the attack as “unprovoked and violent”.
Hurmiz was sentenced to three years and eight months behind bars, with a non-parole period of two years and four months.
With time already served, he will be eligible for parole in late 2024.
Judge Pillay told Hurmiz, who was standing in the dock with his arm tattoos on show, that he hopes he turns away from a “path of criminality”.
“There is great hope for you in the future if you make positive decisions,” he said.
Verigos was sentenced to three years’ jail, with a non-parole period of 21 months.
Workman was slapped with a three-year community corrections order.
