Lawyers for Comanchero Mick Murray have urged Victoria Police to hand over material linked to the alleged slaying of a Tony Mokbel associate as he prepares to fight the murder charge.
Murray is set to learn before the year’s end whether he will join his two co-accused in the Supreme Court trial early next year over the alleged execution of Mitat Rasimi.
Murray was in April charged with the 2019 murder of the gangland figure and bikie associate.
With his trademark neck tattoos peeking out the top of a bright red jumper, Murray faced the webcam from his holding cell at Barwon Prison.
Murray has been on remand at the jail since his arrest in pre-dawn raids at his Lysterfield South home in late April.
During an administrative hearing at Melbourne Magistrates’ Court on Thursday, prosecutors outlined several expert witnesses to be called at the contested committal later this year, including statements from Optus and Vodafone employees, as well as material related to maps and cell tower locations.
But defence lawyer Adam Chernok, for Murray, said the defence was still waiting on specific material to be handed over by the prosecution.
“We’ve had the usual response that it’s not in the possession of the (Office of Public Prosecutions) and been referred to Victoria Police,” Mr Chernok said.
Lana Treasure, for the Chief Commissioner of Police, told the court material was still being collated but it’s expected there will be public interest immunity claims made which could take “some time”.
Talk of a committal hearing slated for January were interrupted when Murray alerted the parties to the fact “the trial (for his co-accused) is in February”.
Fellow Comanchero Richard Ene, 26, and Laiseni Kakato, 28, were charged with Rasimi’s murder in November 2019 and February 2020 respectively.
The pair pleaded not guilty and are due to face trial on February 13.
Rasimi was ambushed execution style on March 3, 2019 in Dandenong over a $300k debt owed to the Comancheros by his brother, prosecutors alleged in an earlier court hearing.
The burly 51-year-old was sitting in his car on Dawn Ave when he was shot repeatedly.
He was found unresponsive, with four bullet wounds to the chest, after crashing his Peugeot Coupe into a pole as he attempted to flee his attackers.
Murray will face a four-day committal hearing in December.
