David Fosita charged after sister fell from moving car on the Princes Freeway

A woman told her brother she was afraid of him before she fell from a car travelling at 100km/h on the Princes Freeway and suffered critical injuries, a court has heard.

A driver whose sister was critically injured after she fell out of a car travelling at high speed on a Victorian freeway has been denied bail.

David Fosita, 28, is facing charges including criminal damage after his 30-year-old sibling fell out of a Honda Civic travelling at 100km/h on the Princes Freeway towards Geelong on Sunday.

Police allege the woman exited the vehicle after Mr Fosita punched the stereo and broke it during an argument in which he blamed her for the death of their other sister two months prior.

“The complainant began telling the accused that the family talk about him behind his back,” court documents state.

It’s alleged the woman told her brother she wanted to get out of the car because she was in fear of him.

Witnesses saw the passenger side door open before the woman fell onto the road and into oncoming traffic between the Werribee and Little River exit about 11.45am.

She was flown to The Alfred hospital in a critical condition with serious injuries to her head and body.

Mr Fosita spoke to investigators at the scene before he was arrested and taken to Werribee police station.

Outbound lanes were closed for several hours on Sunday afternoon.

Mr Fosita is facing other charges including possessing cocaine and diazepam and was denied bail at Sunshine Magistrates’ Court on Tuesday.

It is his first time in custody and he will return to court on January 19.
