Bikie boss Toby Mitchell is facing the clink if a court finds he broke his promise to be of good behaviour for six months.

Mitchell was due to front court on Tuesday, six months after he was given a chance on a bond over two separate street attacks, including one in which he was knocked out by a homeless man.

But Judicial Registrar Alison Paton declined to sign off that the Mongols president had complied with the adjourned undertaking, after Mitchell pleaded guilty to a drunken fight at an Echuca pub in November.

However, Ms Paton said she could not be satisfied a breach of the bond had occurred because Mitchell was appealing the matter in the County Court.

The OMCG chief, who did not appear in court on Tuesday, last month abandoned his fight against a common law assault charge, stating he would be appealing his two-month prison sentence only.

Mitchell was handed the good behaviour bond in September last year after he pleaded guilty to counts of unlawful assault over the ugly brawls in Southbank and South Yarra in 2020.

The former kickboxing champion was knocked unconscious after getting into biffo with an unknown man on the Southbank Promenade in November 2020.

Mitchell was already on bail at the time over another drunken assault on a man outside Gilson cafe on Domain Rd in South Yarra a month earlier.

During the spat, Mitchell slapped the victim three times with an open hand, in what his lawyer Damian Sheales labelled “the most minor incident ever”.

Mitchell was also slapped with a $2500 fine but escaped conviction after spending several months last year attending anger management courses and alcohol awareness programs.

But not even halfway through his six-month good behaviour commitment, Mitchell was back before the court, charged over a fight at the American Hotel in Echuca.

Mitchell had been in the border town with more than 100 bikie brothers riding through the streets for his birthday before he was caught on CCTV hitting a man in the face on November 28.

Within minutes of being sentenced to a two-month jail stint that would have put him behind bars for Christmas, Mitchell appealed and was bailed, later claiming on social media “no victim no injuries but trial by media as always”.

Last month, Mr Sheales said Mitchell was “anxious to have the matter dealt with as soon as possible”.

Mitchell will return to the County Court on April 7.

His bond review was adjourned to a later date, pending the outcome of his appeal.
