Bikie boss Toby Mitchell has abandoned his fight against charges over a pub slap during his Echuca birthday bash.

But the Mongols president is still contesting a two month jail sentence he copped after twice striking a punter to the face.

Mitchell was in the border town with more than 100 bikie brothers riding through the streets for his birthday before he was caught on CCTV hitting a man in the face on November 28.

A court previously heard Mitchell asked the America Hotel bar manager to “get rid of the CCTV” after he punched and slapped the victim, who fell to the floor.

Within minutes of being handed jail time that would have left him spending Christmas behind bars, Mitchell appealed and was bailed, later claiming “no victim no injuries but trial by media as always”.

The OMCG president joined lawyer Theo Magazis for a brief online hearing in the County Court on Friday morning, where he dressed for the occasion in a black hoodie featuring a skeleton hand flipping the bird.

The same fashion statement was seen in footage of a police raid on his Southbank home in December, where he was put in handcuffs and led away by officers.

Defence lawyer Damian Sheales told the County Court it was “going to be an appeal against sentence only”.

“My client instructs me that he’s anxious to have the matter dealt with as soon as possible,” he said.

Mitchell’s bail was extended and he will return to the County Court on April 7.
