Rahamutallah Rahamutallah: Accused Werribee rapist’s bail bid

A man accused of orchestrating the vile gang rape of two underage girls in Werribee, which involved plying them with booze and drugs before they were assaulted, has asked the County Court for bail.

A man accused of orchestrating the vile gang rape of two girls in Werribee has been granted bail despite police fears he could skip the country.

Rahamutallah Rahamutallah, 24, is accused of luring the girls, then aged 11 and 12, to a Werribee home in December, 2018, where he allegedly raped them with two of his mates Noor Hason, 30, and Mohammed Nuramin, 22.

Each of the men has been charged with sexual penetration of a child under 12, sexual penetration of a child under 16, sexual assault of a child under 16, and supplying a drug of dependence to a child.

But following the temporary suspension of his trial earlier this year due to the coronavirus, Mr Rahamutallah faced the court on Thursday where he asked to be bailed to immigration detention.

Sarah Thomas, appearing for the Department of Public Prosecutions, told the court Mr Rahamutallah was an illegal immigrant from Myanmar whose ability to reside in Australia following his trial was uncertain.

If he was released into immigration detention he could request to be deported, preventing the court proceedings from being concluded, she told the court.

He could also apply for a new visa to stay in the country and would have contact with his co-accused, Mr Nuramin, who had previously been bailed to the centre.

“There’s also the ability to use the telephone which is unmonitored (to contact the victims),” Ms Thomas told the court.

“For a few weeks after the offending Mr Rahamutallah was repeatedly calling (one of them).”

But Michael Sharpley for Mr Rahamutallah told the court it was “fanciful” to suggest his client would conspire to change his story while detained with his co-accused.

Ms Thompson also earlier told the court Mr Rahamutallah was banned from re-entering Myanmar and Mr Sharpley said his client had not expressed any desire to flee overseas.

“The suggestion that some brand new story will be dreamt up by Mr Nuramin and Mr Rahamutallah while in immigration detention is really fanciful,” Mr Sharpley told the court.

“The evidence has been given, it can’t be contaminated … it will be played to the next jury.”

“Mr Nuramin has received bail for the purposes of being in immigration detention. Mr Rahamutallah is in precisely the same situation, why should he be denied the bail that Mr Nuramin has.”

Judge Rosemary Carlin granted bail, telling the court she was not convinced Mr Rahamutallah posed a credible risk of leaving the country or obstructing the course of justice.

She also noted he’d already spent more than 20 months behind bars for the alleged offences and it was likely he faced a lengthy wait for a new trial date to be set.

Mr Rahamutallah was bailed but must spend two weeks in quarantine before being transferred into the centre. He is due back at court on January 18 next year.
