Noor Panjshiri: jail for Dandenong man who plied teen girl with ice, infected her with HIV

An “seriously disturbed” Afghani refugee who plied a teen girl with ice, had unprotected sex and infected her with HIV could be back on the streets in less than a year.

An Afghani refugee who infected an underage girl with HIV after he fed her drugs then had unprotected sex with her was told he was a “high risk” of transmitting the disease just days earlier.

HIV positive Noor Panjshiri was warned by a doctor not to have unprotected sex with anyone less than a week before he infected his 16-year-old victim in June, 2017.

The girl told her 14-year-old friend – who knew Panjshiri – she wanted to try meth, a court heard.

The friend said Panjshiri would supply meth in exchange for sexual favours.

Panjshiri, also known as Chris, picked the two girls up from Dandenong station and drove them to his unit on June 27.

The trio smoked ice together and Panjshiri had unprotected vaginal, anal and oral sex with both girls.

The 16-year-old victim reported Panjshiri to police after she tested positive to HIV.

She said during a recorded interview that she vomited after having sex with Panjshiri, and felt unwell the next day.

A doctor said it was “highly plausible” she became infected towards the end of June.

Earlier in 2017, the girl returned a negative HIV test taken before June 27.

Panjshiri took the matter to a trial.

He denied having sex with the girl claiming she was infected by someone else but a jury dismissed both claims.

Panjshiri, 37, was sentenced in the County Court yesterday to a minimum three years and three months after he was found guilty of negligently causing serious injury, and two counts of supplying a drug of dependence to a minor.

The court heard Panjshiri, who tested positive to HIV in 2009, had maintained his viral loads until 2015.

Panjshiri said he did not regularly take his antiviral medication after 2015 because he was broke.

A doctor said Panjshiri had an “extremely high” viral load when he had unprotected sex with his victim.

His defence counsel submitted Panjshiri was forced to flee Afghanistan in 1999 after a freedom fighter he fought alongside was assassinated.

His counsel said Panjshiri could not return to Afghanistan because his father and family had disowned him after they learnt he was HIV positive.

Panjshiri’s family in Melbourne advised him to “commit suicide”.

It was also tendered Panjshiri has been bashed three times since he entered custody.

As a result, Panjshiri was been shifted around prison 20 times.

In response, the prosecution argued Panjshiri’s “drug-fuelled” offending ended with a “devastating outcome”.

“This is a disease she will be living with for the rest of her life,” the prosecutor said.

A psychologist reported Panjshiri was a “seriously disturbed” man with “anger problems”.

Panjshiri also has a “significant criminal history” which included multiple assaults, family violence and a false imprisonment charge.

Panjshiri committed the latter charge against a waitress at an Afghani restaurant he used to own.

Judge Greg Lyon said Panjshiri had “rather poor” prospects of rehabilitation.

“(Your offending) was reprehensible because it was preventable,” Judge Lyon said.

(The HIV virus) will presently stay with the victim for life.”

Judge Lyon also cited current medical opinion where the lifespan of a person with HIV will be diminished by “about 10 years”.

“I hope you (the victim) can have some resolution,” Judge Lyon said.

Panjshiri, who had spent 832 days in custody up until yesterday, was sentenced to a maximum five years and four months’ prison.
