A DUNNY dispute involving Jimmy Barnes’ wife has inadvertently led to a bizarre breach of a family violence order.

The “facilities” complaint by the colourful crooner’s companion meant a southeastern suburbs man broke an order banning him from being near his former partner’s property.

The contractor, who has an indefinite order against him, is forbidden to be within 2km of the woman’s Mornington Peninsula home.

Frankston magistrates Court yesterday heard circumstances dictated he had to deliver a deluxe dunny to the singer’s better half.

The court heard the man had sent tickets to his young daughter to the Under the Southern Stars music festival being held on a Mornington Peninsula foreshore in January.

She didn’t go, and instead her mother (the man’s former partner) went with a friend.

During the festival the man was called by the event organisers after a complaint was made by Barnes’ wife that the bathrooms were not up to scratch.

He was told the “facilities didn’t meet the standards Mrs Barnes thought appropriate”.

He was asked to provide a more luxurious set-up, and found an “executive caravan”, which he towed to the site.

He was allowed to drop it off by police, but could not leave the premises because of traffic issues and instead thought he would wait backstage.

But the woman was in the crowd, saw him and reported the breach.

The defence lawyer said his client had not seen her, and only realised there was a breach when he was contacted later by police.

He also mistakenly thought the order allowed him to be within the 2km buffer zone of her house if police were in attendance.

The actual distance from the event to the woman’s home was around 1km, the court heard.

The man, who has a six-page criminal history including breaches, threats to kill and reckless cause injury, could have been jailed.

But magistrate Rodney Crisp accepted the breach was inadvertent, instead convicting him and fining him $1000.

He warned him the “merest threatening gesture” in the future would likely mean imprisonment.
