A dope-smoking amnesiac who couldn’t remember threatening to stab a doctor in a hospital emergency department with an oyster shucking knife has been jailed.

Timothy Rich – who also smashed a water cooler in a bank, urinated in police cells and resisted arrest – was given two months behind bars for a nine-month-long drug-fuelled crime spree.

But he has already served far more time than that on remand, and has now walked free.

The Dromana drug-abuser pleaded guilty to 15 drug, violence, criminal damage and court order breach charges at Frankston Magistrates’ Court yesterday.

The court heard his offending kicked off – literally – on March 26 last year at the Rosebud NAB branch.

He believed the bank was withholding some of his money, and began abusing staff before kicking over and smashing a water cooler on his way out.

On May 1 he spent three days at his mother’s house, which was forbidden by a previous court order, before calling her a “dumb bitch” and leaving.

She had been too scared to call police.

Rich’s worst offending came on December 10 last year when he walked into Rosebud Hospital emergency department and demanded “a bed for the night”.

When he was asked to leave he produced an oyster shucker and said he was going to knife a doctor before stabbing randomly at glass doors and then walking off.

On January 3 this year he was found in a drug-induced state on a nature strip in Dromana with a bag of cannabis. On January 5 he went to a Caltex servo in Dromana and refused to leave, with arresting police finding ice pipes and more cannabis on him.

On January 7 he urinated all over Frankston police cell walls, floors and doors because he reckoned he “couldn’t find the toilet”.

A day later, he was reported to be at another house he was legally barred from and, when asked to leave, he resisted arrest and had to be restrained.

Appearing via video, Rich appeared frustrated with the hearing, shouting that he had been “ripped off” by the bank before being warned any more outbursts and the link would be cut off.

Rich’s defence lawyer said the disability support pensioner couldn’t remember threatening the doctor, but was nevertheless sorry for what he had done.

Rich said he didn’t have a problem with ice, telling the court he was “handing in” the ice pipes he had found to servo staff, but he did admit using cannabis.

He said he had mental health issues and his support mechanism crumbled when his father recently passed away.

Rich had already served 103 days on remand while awaiting his case.

Magistrate Charles Tan said the emergency department incident was “concerning”.

“That you can’t remember pulling a knife on a doctor is serious,” Mr Tan said.

“You need to keep in touch with (mental health and drug) supports, (and) make sure you look after your issues once you get released.”

Rich was jailed for two months, time he had already served, convicted and fined $1000.
