Son, 36, abused, pushed and spat on mum and dad in a fight over a PlayStation video games console

A drunk son, unhappy about having to share a PlayStation game with his young nephew, lost the plot. He took his anger out on his parents, abusing them, pushing his dad and spitting on his mum.

A drunk 36-year-old son who spat on, pushed and abused his parents in a stoush over a PlayStation has escaped a jail sentence.

Michael John Ewin was still living with his mum and dad in their Cranbourne home when the video game console chaos erupted.

The 36-year-old concreter pleaded guilty to two unlawful assaults and one criminal damage charge at Frankston Magistrates’ Court on Monday.

The court heard Ewin was at the house he shares with his parents at around 2pm on December 21, 2018 when there was a disagreement with a nephew over a PlayStation.

A drunk Ewin pointed a finger aggressively at another nephew and when his mother came in to settle things down, he became extremely angry.

He threatened his mum and screamed obscenities at her.

Then he picked up her sunglasses and smashed them, so she called his dad and Ewin left the house.

At around 9pm that same day he returned and threw some keys at his father, calling him a “weak dog” for phoning the police and started scuffling with him.

He pushed the older man out of the front door and locked him out, while he went up to his mum and stood over her, pretended to headbutt her and spat in her face.

Police arrived and Ewin was arrested, and while he admitted breaking the sunglasses he denied the assaults or spitting.

He defended himself in court, saying he had been drinking and was ashamed of his actions.

“It was not my finest day,” Ewin said.

His parents were also in court to support their son, who has now moved out of their house.

Magistrate Timothy Gattuso said his behaviour was “completely unacceptable”, and any repeats would likely end up with him behind bars or serving a community corrections order.

“This is absolutely no way to behave towards anyone, let alone your parents,” Mr Gattuso said.

“You suggest it was a one-off and not a regular occurrence, I certainly hope not.

“Don’t ever act in that way again.”

Ewin was convicted and fined $1500.
