Man allegedly bashed, threatened and smeared faeces on former partner’s face

A man who police allege bashed and threatened to rape and kill his former partner while smearing her face with his faeces has been refused bail.

The magistrate ruled, despite a risk of delay in hearing his case due to COVID 19 restrictions, he presented too much of a threat to the woman if released.

Brendan Paul Brzezowski was last week remanded by Frankston Magistrates’ Court on assaults, threats and criminal damage charges as well as bail and court order breaches.

The Cranbourne 45-year-old is contesting the case and will be staying behind bars until his next hearing date in late May.

The court heard on October 25 last year, Mr Brzezowski’s then-partner was taking a shower when he allegedly walked into the bathroom and demanded she have sex with him.

When she refused he allegedly shoved her into the shower door, and then grabbed, kneed and punched her.

Police allege he then went outside and dented her car before coming back inside, smearing her with his faeces while threatening to rape and kill her.

She then allegedly rang police, telling officers he “had gone psycho” and that they needed to hurry up because he had “put s**t all over my face”.

Mr Brzezowski was later tracked down to a Cranbourne motel where he was arrested before being bailed.

A court order was put in place to protect the woman, but Mr Brzezowski allegedly repeatedly called and messaged her.

On January 24 this year as she reported the alleged breaches to police Mr Brzezowski allegedly rang and messaged her while she was at the station.

His defence counsel said bail should be granted because he would be happy to abide by a curfew, report as required to police and had stable accommodation available.

But Magistrate Vicky Prapas said the allegations were serious and there was a high degree of noncompliance with both bail and intervention orders.

She said while she acknowledged Mr Brzezowski was contesting the charges there was material supporting the police case, including the woman’s injuries, 000 calls, the damage to the car and witness statements.

Ms Prapas disputed there would be significant delays due to the coronavirus measures put in place by the courts because family violence matters could be expedited.

“You have failed to show compelling reasons (to be granted bail) … the risk is unacceptable that you will interfere with witnesses and endanger the safety and welfare of another person,” Ms Prapas said.

“The risks could not be ameliorated by any conditions.”

Mr Brzezowski was denied bail and remanded in custody until May 27.
