A man accused of a shocking road rage incident where he allegedly swung an axe at another man’s car has told a court he must be bailed due to a life-threatening illness.
Tristan Nugent, 41, faced the Heidelberg Magistrates’ Court on Wednesday following an alleged road rage incident where he allegedly swung an axe at another man’s car.
Mr Nugent was driving a Holden hatchback when it collided with a Holden 4WD in Watsonia on February 14.
Police alleged Mr Nugent got out of his car and assaulted the man driving the 4WD before swinging an axe at the other man’s car.
Mr Nugent then allegedly fled the scene.
The alleged victim, a 32-year-old Narre Warren man, sustained minor injuries and was treated at the scene.
Mr Nugent, who appeared via video link from custody, was supported in court by his mother.
After his lawyer Chris McLennan told the court his client would not be applying for bail, Mr Nugent said “I’m making a bail application for myself today” due to him having a “life threatening illness” in his leg.
“I’ve got a bacterial infection that’s infected my joints and my bones all through my leg,” Mr Nugent told the court.
“(There’s) no medical treatment in the jail system.”
The matters had already been finalised however and Mr Nugent was remanded into custody to next appear on March 26.
After Mr Nugent left the link, his mother told the court his injuries were serious and that he was being checked for “auto-immune disorders”.
He had previously been in the Austin Hospital, the court heard.
The court heard the Wattle Glen man could be withdrawing from ice and would need to see a custody nurse as soon as possible.
