A Hells Angel bikie boss is fighting drug charges in court, claiming that his ADHD medication was the reason he allegedly tested positive for meth.

Luke Moloney, one of Australia’s most senior bikie bosses, contested the alleged charges against him when he appeared via video link at Heidelberg Magistrates’ Court on Tuesday, December 6.

Currently in custody having served almost eight months of pre-sentence detention, the 42-year-old Reservoir man disputed the alleged possession of a drug of dependence and breach of his bail conditions.

In March, Moloney was driving in Preston and intercepted by police when he allegedly tested positive for methamphetamine, violating his bail terms.

Moloney’s lawyer, Mark Gumbleton, said the drug test may have been inaccurate as Moloney was taking the prescribed drug dextroamphetamine to treat ADHD, which may have caused the positive meth test.

The court heard Moloney had been diagnosed with an acquired brain injury and would be receiving MRI scans concerning “white matter” that had been found on his brain.

Moloney also disputed another instance of violation of his bail, where he was not permitted to associate with anyone related to the Hells Angels bikie club.

Police executed a search warrant of Moloney’s Reservoir home in April and seized his phone, to find message conversations with a man who was allegedly a prospective Hells Angels member.

The messages were asking Moloney for support to become a member of the Dark Side or City chapters of Hells Angels.

Mr Gumbleton argued that because the man was not yet a member of the club, this did not breach Moloney’s bail conditions.

Moloney will return to Heidelberg Magistrate’s Court on February 20.
