A Braybrook man who used Snapchat to repeatedly film and photograph himself performing sex acts with a 14-year-old girl has avoided jail.
Joshua James Robert Calladine was sentenced to a two-year corrections order with 300 hours community work before the County Court on Monday, having pleaded guilty to charges including sexual penetration of a child under 16 and intentionally producing child abuse material.
Police were investigating the 19-year-old for a violent robbery when they found 29 explicit videos and 152 explicit images on his phone, taken on eight occasions in 2019.
The court heard the videos and photos, all captured using social media sharing application Snapchat, depicted sex acts and nude photos, with all believed to involve the same 14-year-old girl.
Calladine’s text conversations revealed he had also had sex with the girl on several other occasions and had asked her to send nude photographs of herself to him.
Calladine was 18 at the time and well aware that the girl was four years younger.
He was arrested on January 20 and held in custody for five days before being granted bail.
The court heard he had been unemployed since leaving school at Year 11 and had low intellectual functioning.
It was heard he had been doing counselling since his arrest, was remorseful and had complied with his bail by not having contact with the girl, despite her efforts to contact him.
Judge Sarah Leighfield also noted the benefit of Calladine’s plea, and that he was a young and first time offender.
She said he had very good prospects of rehabilitation and noted Calladine had only just become an adult when the crimes occured.
Judge Leighfield said custody would not be conducive to his ongoing rehabilitation and granted an application for Calladine to avoid being placed on the sex offenders register.
