Shane Smythe was drunk when alleged assault and aggravated burglary occurred: Mildura Magistrates Court

A Robinvale man allegedly broke into a house, assaulted a sleeping man, and smashed all the windows while drunk, a court has heard.

A Robinvale man has been accused of allegedly breaking into a house and punching a man in the face while he slept.

Shane Smythe, 39, fronted Mildura Magistrates Court on multiple charges, including alleged aggravated burglary with intent to assault.

Mr Smyhte spent almost the entire bail hearing with his head in his hands, while his father was there to support him in court.

The charges Mr Smythe faces stem from an incident on July 20 where he is alleged to have broken into a house through a bedroom window and allegedly began assaulting a man while he slept.

Mr Smythe has also been accused of causing extensive damage to the property following the alleged assault when another person living at the house asked him to leave.

Police alleged Mr Smythe smashed multiple windows and TVs at the residence after he reportedly challenged another member of the house to a fight.

The court heard that Mr Smythe allegedly threw a gas bottle through a window before police arrived.

Police claim he was drunk when they arrested him.

Another drunken escapade saw him taking a $90 taxi ride, allegedly knowing he didn’t have the money to pay the cab fare.

The court heard that during the journey in the taxi, Mr Smythe allegedly challenged the cabbie to a fight.

On another occasion, Mr Smythe is accused of threatening to kill a man with a large knife, telling his alleged victim that if he ever came back to Robinvale, he would kill him.

Mr Smythe was bailed and his next court appearance is slated for July 30 at Robinvale Magistrates’ Court.
