Samuel Jaska pleads for bail after alleged backyard brawl and home invasion leaves ex-housemate hospitalised

A Mildura boilermaker has pleaded with a magistrate for bail, claiming he is unfairly implicated in an alleged backyard brawl that left his former housemate hospitalised.

Samuel Jaska appeared in Mildura Magistrates’ Court after being charged with unlawful assault stemming from an alleged altercation with his former housemate.

Police alleged Mr Jaska and two co-accused attacked the man following an argument in the backyard of the property. The alleged victim’s car was damaged, and a window was smashed during the incident as the trio allegedly entered the house.

The court heard the alleged victim was beaten by the trio until another man came to his rescue and called triple-0. It was claimed Mr Jaska then left the house in his red Ford Falcon, while his two co-accused allegedly fled in a Toyota Land Cruiser.

Mr Jaska allegedly returned to the house while police were in attendance.

The alleged victim told police that he would not be supportive of Mr Jaska’s bail application.

Mr Jaska, who was representing himself, told the court, “Your honour, I was not formally involved with (the two co-accused) and that is all I have to say.”

“I have been a good boy for a long time, sir,” Mr Jaska said.

Police said Mr Jaska denied the version of events read out in the summary and said the alleged victim had thrown the first punch.

Mr Jaska told the court he had planned to leave Mildura for Queensland in December to start working with his dad.

“The problem is you have to prove exceptional circumstances. They are very serious charges,” Magistrate Patrick Southey said.

“And at the moment, I don’t see what the exceptional circumstances are,” he said.

Mr Jaska pleaded with the court at the end of his hearing, saying he didn’t belong behind bars for his role in the alleged incident and reiterated he had nothing to do with his two co-accuseds’ alleged actions.

“Please, your honour. I don’t deserve this, please, your honour, I’ve admitted everything I have done,” Mr Jaska said.

Mr Southey wasn’t moved, however, and rejected Mr Jaska’s bail application.

”You sound genuine, you sound well spoken, but at this stage there is not sufficient reason to grant bail,” Mr Southey said.

Mr Jaska is next slated to appear in court on February 26.
