Dieudonne Nsengiyumva: Mildura man sentenced over sexual assault in 2015

A former Mildura mechanic sexually assaulted a woman, telling her to rub tissues all over her body and to stop screaming because he “didn’t want to go to jail”.

A former Mildura mechanic has avoided jail after he sexually assaulted a woman, telling her to rub tissues all over her body, before dropping her at her parents’ home.

Dieudonne Nsengiyumva, 39, was sentenced to a 12 month community corrections order in the County Court on Wednesday after he earlier pleaded guilty to sexual assault.

The court heard the father of five told his victim he could “teach her something” before he sexually assaulted her more than five years ago.

He said it would cost her $50, which the victim paid, before Nsengiyumva used the money to pay for a motel room.

Once there Nsengiyumva gave the victim a document about male and female relationships.

He told her to go to the bathroom and get three tissues and rub them over her breasts and genitals.

The court heard Nsengiyumva told the victim she had done it wrong and that he was going to do it himself.

When she refused Nsengiyumva held her down by the hips and touched her stomach; telling her that he had spent money to be in the room and she couldn’t leave.

He undid his belt and pants before pulling down the victim’s skirt and underwear and touching her.

The victim begged him to stop and started to scream.

Nsengiyumva told her the window was open and he “didn’t want to go to jail”.

The victim eventually left the motel, and when she returned told him she wasn’t coming into the room.

But the court heard he lured her in and locked the door.

Eventually Nsengiyumva dropped the victim at her parents’ house where she had been living.

In her victim impact statement the victim said the event had affected her trust and robbed her of her happiness.

“It made me feel like I could not trust anyone,” she said.

“I am normally a very happy girl but after this I was hurt, broken and full of anger.”

The court heard the case had made it difficult for Nsengiyumva to provide for his family.

Judge Phillip Coish did not impose a condition that he would have to undergo any rehabilitation programs.

He said it would be “counter productive” for Nsengiyumva to be travelling to Melbourne as he was avoiding jail time so that he could support his family.

Judge Coish also said considering the isolated nature of the attack and his “stable domestic circumstances” when sentencing.

The victim expressed her support for Nsengiyumva not being jailed so he could continue to support his family.
