Hampton East cop-hater resists arrest, racially abuses and assaults police officer

A woman has racially abused a police officer after being asked to be searched before injuring his finger in a scuffle while resisting arrest.

A woman who called a police officer a “black b******” and bruised his finger after being asked to be searched for drugs has been given a good behaviour bond.

Janelle Tania Smith, 48, faced Moorabbin Magistrates’ Court yesterday charged with resisting arrest, assaulting an emergency worker and offensive behaviour charges.

The court heard Smith got out of a car and walked towards her Hampton East apartment when police, who suspected she was drug-affected, asked her to stop about 5pm on March 23.

Police went to search her and the car but she refused and kept walking before lashing out at one of the officers she knew — and disliked — calling him a “black b******”.

Smith was again asked to comply, but refused and pushed the officer away.

She was taken to the ground and handcuffed and, in the struggle, bruised the officer’s finger.

Her handbag and car were searched but nothing was found.

Smith’s defence lawyer said his client, an Aboriginal woman, had significant mental health concerns, for which she was now getting support.

He said the injury to the officer, who had “had previous dealings” with Smith, was slight and minor.

Magistrate Anne Goldsbrough said the charges — to which Smith pleaded guilty — were serious and her behaviour was offensive.

But Ms Goldsbrough said there was a significant mental health concern involved, which was now being treated, and she had accepted responsibility.

Smith was convicted and given a 12-month good behaviour bond with the condition she continued to receive counselling for her issues.
