An Irish national who sexually assaulted a female American student at a hotel after approaching the victim at Billboards nightclub has avoided a jail term.
Connor Brennan, 21, was sentenced in the County Court on Friday to a 10-month community correction order after pleading guilty to sexual assault.
Brennan violated his victim after meeting the young woman at the city nightclub in May last year.
Brennan approached the victim and her friend at the bar shortly before he was ejected from the Russell St venue.
However, the victim, her friend and Brennan’s mate all returned to a room at the Imagine Marco Hotel where they found the grub passed out naked on a bed.
The court heard the victim, who was “concerned” for Brennan’s wellbeing, fetched the “unresponsive” Irishman a glass of water.
The victim touched Brennan’s shoulder and woke him.
Brennan, whose eyes were “half open”, drank some water then grabbed the victim’s arm and attempted to drag her onto the bed.
Brennan then pushed the victim which caused her to lose balance, fall backwards and hit her head on a mirrored door.
Brennan grabbed the bleeding victim and pushed her on the bed before
climbing her, where he sat on her chest and pinned the young woman’s arms next to her head.
The victim told Brennan to get off and she shouted for help but he performed a vile sexual offence with his penis.
Brennan then grabbed the victim’s head and “gripped” her hair.
“Stop, get off, why are you doing this,” the victim told her assailant.
The victim was able to free herself from Brennan and escape the ordeal which the court heard lasted “2-3 minutes”.
“Oh my god, look in the mirror … what happened,” the victim’s friend said after seeing the blood gush from her pal’s forehead.
The victim told her friend Brennan had “pinned her down and assaulted her”.
The victim and her friend left the hotel after they took photos and confronted Brennan.
Police investigated and arrested Brennan in August last year.
Brennan told police he was “very drunk” and remembered “dribs and drabs of what happened”.
Brennan also recalled the victim’s head was bleeding and she took a picture.
Brennan also claimed the victim came into his room and asked if he wanted water but he
“responded no” and “went back to sleep”.
Brennan said he could not remember what happened after the victim gave him water but he denied picking the victim up and pushing her onto the bed.
Brennan also denied sitting on top of the victim’s chest and performing a lewd act with his penis.
Brennan also denied pushing the victim and he did not remember her hitting her head.
The victim, an American student on a visa, has since returned to the United States, the court was told.
The court heard Brennan grew up in Ireland and came to Australia for a working holiday.
Brennan, who is a machine operator at a rural Victorian property, was convicted and placed on the court order.
