A Seymour man who allegedly killed a motorcyclist at Yarck was allegedly seen trying to escape the vicinity of the collision by hitchhiking, a court has heard.
David Graham Berry, 42, fronted the Melbourne Magistrates’ Court charged with dangerous driving causing death, fail to stop and render assistance, burglary and theft.
Mr Berry appeared in the custody dock in an Everlast T-shirt, where he seemed to be in a lot of pain as he was flanked by two custody officers.
Magistrate John Hardy asked Mr Berry if he was in pain, to which he replied “yeah” while telling the court that he just vomited.
It is alleged Mr Berry stole a white Ford Ranger from the Euroa ‘Middle Pub’ at 2.40pm before allegedly ploughing into a motorcyclist at Yarck while driving on the wrong side of the road just over an hour later.
The 56-year-old Alexandra man died from the head on collision.
The court heard that Mr Berry then allegedly fled on foot, and was found trying to hitchhike a lift out of the vicinity.
After an extensive search by police, they allegedly found him and arrested him.
Mr Berry applied for bail, with his lawyer Daniel McGlone arguing that due to his “Indigenous background, coupled with his substance abuse”, he should be eligible for bail.
Mr Hardy responded, saying that Mr Berry “is going to jail for years” if he is convicted of the dangerous driving causing death charge.
Mr Hardy also said that there was “strong evidence” Mr Berry committed some offences in Euroa, took keys and took the Ford.
Ultimately, Mr Hardy said that while Mr McGlone had given compelling reasons for his client to be granted bail, he was an unacceptable risk of reoffending.
Mr Hardy said that Mr Berry needs to be seen by a medical practitioner as soon as possible while in custody.
Mr Berry was remanded to appear in court on May 15, with the matter adjourned part heard.
