Freed immigration detainee Abdelmoez Mohamed Elawad bailed in Broadmeadows Magistrates Court

A fourth detainee released from indefinite immigration detention after the government’s indefinite detention policy was ruled illegal has secured bail when authorities did not oppose his bid for temporary freedom.

A fourth detainee released from indefinite immigration detention after the government’s indefinite detention policy was ruled illegal has secured bail when authorities did not oppose his bid for temporary freedom.

Abdelmoez Mohamed Elawad, 45, fronted the Broadmeadows Magistrates’ Court on Friday flanked by two security guards and an Arabic interpreter shortly after 2pm.

The Australian Federal Police did not oppose his application for bail.

The AFP arrested the Sudanese-born man early last month after he was found at a Melbourne hotel.

Police allege Mr Elawad breached a condition of the visa he was placed on after his release by failing to follow his residential curfew.

It’s also alleged he went to Melbourne airport and stole luggage from a sleeping traveller.

He is charged with one count of theft and one count of failing to comply with his curfew and will reappear in the Broadmeadows Magistrates Court on February 5.

Mr Elawad was the fourth person to have been arrested and charged with a crime after he was released from indefinite detention in a landmark High Court ruling on November 8.

A total of 148 non-citizens had been held because they failed the character test for a visa, but have now been released into the community.

Many were later placed on conditions including curfews and electronic monitoring after emergency legislation was introduced by the government.

In court on Friday, Mr Elawad’s lawyer Daniel McGlone said when his client was released from Immigration detention following the High Court ruling, he was to have been taken in by the social organisation Life Without Barriers (LWB) but that didn’t happen.

Mr McGlone referred to a number of health issues Mr Elawad was facing and said the latter has been connected to a mental health practitioner.

He asked that Mr Elawad be bailed to the Court Integrated Services Programme (CISP) that provided support and coordinated referrals to a number of rehabilitation services.

Mr Elawad would then be transferred to LWB, he submitted.

Magistate David Langton said one condition of the bail would be for Mr Elawad to comply with all strict conditions of CISP.

Mr Langton said Mr Elawad’s visa also had strict conditions and if he were in breach of his bail, he would breach his bail terms as well.

During his court appearance in December, the court was told he suffered from schizophrenia and had received treatment for the illness while in detention, but had not received any care following his release.
