A fourth detainee released from indefinite immigration detention has fronted court for the first time for allegedly breaching his reporting obligations and stealing luggage from Melbourne Airport.
Abdelmoez Mohamed Elawad, 45, appeared in Melbourne Magistrates’ Court on Thursday charged with failing to observe his residential curfew obligations and theft.
Wearing a white T-shirt, the Sudanese-born man required the assistance of an interpreter and was flanked by custody officers as he was brought into the dock.
No details of the allegations against him were aired during the brief administrative hearing.
Mr Elawad’s lawyer said his client was receiving treatment for schizophrenia in immigration detention and had a number of health issues including HIV, diabetes, drug withdrawal, high cholesterol and blood pressure.
Magistrate Tara Hartnett ordered he be treated by Forensicare medical staff.
Australian Federal Police arrested Mr Elawad after finding him at a Melbourne hotel on Wednesday.
It is alleged he breached conditions of his Commonwealth visa on December 1 by failing to observe his residential curfew obligations.
He also allegedly went to Melbourne Airport, where he is accused of stealing luggage from a traveller who was asleep in the terminal.
Mr Elawad was one of 148 people released last month after a landmark High Court decision found indefinite immigration detention was unlawful where it is not possible to deport a non-citizen.
He made no application for bail and will face Broadmeadows Magistrates’ Court on January 10.
