An airport worker who followed a woman to her car in Melbourne’s north and forced her to kiss him while he barred her escape has managed to avoid a criminal conviction.

Samir Kazi, 50, fronted Heidelberg Magistrates’ Court on Wednesday, pleading guilty to a sexual offence.

The court heard Kazi followed a woman he did not know to her car after seeing her at Bingo Bonanza in September last year.

The victim had left bingo just before 10pm and was walking along High St, Epping, when Kazi stopped her.

The court heard he stood in front of her car and insisted, repeatedly, that he should kiss her on the cheek, despite the victim attempting to push him away.

When she felt she had no other choice, he pulled her body towards him and kissed her on the lips, the court heard.

He then positioned himself so she could not close the car door and caused her driver’s seat to fall backwards, before kissing her face and lips again.

She told him she was scared and wanted to leave.

Before she could leave, he insisted on kissing her goodbye for a final time.

When police arrested him the following week, he told the officers he was “single and interested in someone who asks questions in general”.

A victim impact statement read to the court heard the the incident had “left a lasting scar” on the woman whose trust in men had been shattered.

She described having flashbacks, nightmares and being afraid to go out in public.

Defence lawyer Ennes Marcellus told the court it was his client’s first criminal offence, but conceded it was serious and unacceptable behaviour.

Magistrate John Bentley described Kazi’s behaviour as “incredibly disturbing”.

“A woman has a right to go out at night and feel safe,” he said.

“This lady was traumatised by his creepy behaviour … (and he) thinks it’s totally acceptable to follow a person he has never seen in his life out to her car.”

Mr Bentley said Kazi had committed “a very serious offence” but did not give the airport worker a criminal conviction.

Kazi was instead sentenced to an 18 month community corrections order and ordered to complete educational programs.
