A Monash real estate agent accused of bashing two men at a Wheelers Hill auction has indicated he will fight the charges.

Harcourts agent Andrew Dimashki fronted the Ringwood Magistrates’ Court yesterday where his lawyer Milana Le said he would contest charges of assaulting Heinz Weller and Peter Stewart at an auction last February.

Court documents note Mr Dimashki confronted the men, both of whom were real estate enthusiasts, at a February 23 auction and asked them to leave.

Both men refused, resulting in a scuffle where Mr Dimashki allegedly pushed Mr Stewart, who is mobility impaired and uses a cane, to the ground, causing him to hit his head.

Mr Dimashki also allegedly hit Mr Weller repeatedly with a rolled up brochure and foul language was used by both parties, with Mr Weller allegedly calling Mr Dimashki a “Lebanese c—”, according to the court documents.

Mr Dimashki and prosecutors sought a court diversion for the charges, which would have seen him avoid a criminal conviction.

Ms Le earlier told the court a conviction could compromise her client’s ability to work as a real estate agent because he was often required to undertake police checks.

But Magistrate Mary-Anne MacCallum refused the diversion, telling the parties last week the assault charges were “too serious”.

Mr Dimashki is due back in court on March 30.
