A Queensland man living in Korumburra who threatened to kill another man over a dispute concerning his rescue dogs, has argued it was a “spontaneous outburst”.
Adam Francis, 48, pleaded guilty in Wonthaggi Magistrates’ Court to one charge of threatening to kill and one charge of discharging a missile to the damage of a person.
The court heard on September 10, 2019, local laws officers attended Francis’ address to discuss the status of his three rescue dogs.
Francis was sent into a “mad rage”, storming towards the victim, who lived on the same property.
He abused the victim and said, “You f**king maggot, I’m going to f***ing kill you”.
Francis continued his tirade by picking up objects and throwing them at the victim.
Francis’ lawyer Miceal Ambrose said he was living at the former “crumpling and dilapidated” Korumburra Abattoirs at that time, which triggered this “spontaneous outburst”.
“The behaviour was not repeated,” Mr Ambrose said.
Magistrate Jacinta Studham said Francis’ behaviour was an “isolated incident”.
“The trigger point was when the local law officers came in,” she said.
Ms Studham said Francis was upset about the dogs being removed from him and took his anger out on the “wrong person”.
“No doubt that you were agitated at the time,” she said.
Francis received a $500 fine.
