A Warragul man who was involved in a nightclub brawl has been fined for throwing punches over a spilt drink.
Daniel Golding, 34, pleaded guilty in the Latrobe Valley Magistrates Court to two charges of unlawful assault.
The court heard on December 7, 2019 Golding attended BANK Warragul nightclub with his co-accused.
Just after 11:30pm, a minor verbal altercation occurred between Golding, his co-accused and two other men when the co-accused unintentionally bumped into one of the victims and spilt his drink.
At around 1am on December 8, the two victims were outside in the smokers’ area of the nightclub.
Golding and his co-accused were talking nearby when one of the victims walked past and was confronted by the co-accused.
The co-accused pushed the victim’s chest and the victim pushed Golding in return.
Golding and the co-accused began to throw punches at the victim.
The other victim tried to stop the fight and but he was hit by Golding but uninjured.
The first victim was then knocked to the floor and taken to hospital, but the court heard Golding was not responsible for the injuries.
Golding’s lawyer Steven Pica said he is a father-of-two expecting another baby.
“He has a lot of reason why he should be kept on the straight and narrow,” Mr Pica said.
Magistrate Belinda Wallington condemned Golding’s behaviour.
“You’re a family man and well regarded by your employer,” she said.
“But no matter what the circumstance is, at your age you should be able to navigate your way out of dealing with these types of situations.”
Golding was fined $750.
