A drunken Lavington man who smashed holes through his neighbour’s front door with ametal pole while screaming death threats at him and police has blamed his violent rage on alcohol.
Patrick Light Carmody faced Albury Local Court this week pleading guilty to charges of intimidation, damage to property and being armed with the intent to commit an indictable offence.
At 6pm on November 6, a fight broke out between Carmody and one of his neighbours who lived in the same Lavington unit complex.
Later that night Carmody could be heard yelling threats at the same neighbour, who called the police.
Carmody armed himself with a metal pipe and began to bash on his neighbour’s door, piercing three holes in a metal screen door, and two holes in the wooden front door.
Police could hear Carmody over the phone yelling threats.
“I’m going to put that through his head,” Carmody said.
“I’m going to kill someone.
“If I have to kill a cop I will.
“ … I’m going to smash his head with a crowbar.
“Bring it on c***, bring it on.”
Police found Carmody sitting outside the unit complex where he was arrested.
Defence solicitor Sascha McCorriston said the 29-year-old had already started drug and alcohol counselling.
“Alcohol was a contributing factor to these offences, and he doesn't recall a lot of the offending,” Ms McCorriston said.
While Ms McCorriston said Carmody’s offending didn’t cross the threshold for imprisonment, police prosecutor Andrew Coombs told the court the accused’s offending was “a serious form of intimidation” due to the use of a weapon.
Magistrate Richard Funston sentenced Carmody to an 18 month community corrections order with supervision.
“If I look at your criminal history the common denominator is alcohol,” Mr Funston said.
“If you weren't drinking you may not be before the court at all.
“This is your last chance before your facing a jail sentence.”
