Former Real Housewives of Melbourne star Venus Behbahani is “not financially secure”, doesn’t own a home of her own, and took advantage of her sister’s distress to get control of a luxury Toorak home, according to an extraordinary set of documents filed in the Victorian Supreme Court.
Venus, also known at Venous, launched legal action in the Victorian Supreme Court in March, claiming she was gifted a town house on Canberra Rd, Toorak as part of a complicated series of property transactions during a very brief period, when her sister Rebekah, and Rebekah’s billionaire fiance, Alex Waislitz, had separated.
Venus wants the Supreme Court to declare her the owner of the home, and is seeking an order that the title be transferred to her.
Venus, her husband James Clark, and their children moved into the home in December 2019, but in documents filed on behalf of Waislitz’s company, Thorney Equities which owns the property, it is alleged they ignored a request to move out in November last year.
A counterclaim filed by Thorney Equities is seeking orders that would force Venus, Mr Clark and their children out of the home.
In a defence to Venus’s legal action, Rebekah says she was deeply distressed when her sister “who was not financially secure” presented her with a document in 2019 and said “she needed to sign it”.
The defence revolves around the circumstances in which Rebekah signed the document – a “deed of gift” – which effectively gave Venus the home.
Rebekah claims “by reason of her distressed state” she was incapable of understanding the significance of the document her sister put in front of her.
Rebekah also claims Venus was “in a highly … angry state” when she took her (Rebekah’s) hand, inked her thumb and had her sign the document with a thumb print under duress.
“(Venus) knew full well that (Rebekah) should have obtained legal advice before signing the … document,” the court documents state.
Rebekah and Mr Waislitz rekindled their relationship in late 2019 about a month after their split and the couple have a daughter.
Rebekah has gone on to launch a singing career and released her latest single, Comfortable, last week.
