A GOLD Coast chef kicked and punched a building manager after a minor dispute about a roller door at a Surfers Paradise building.

Nathan Robert Schubert pleaded guilty in the Southport Magistrates Court on Wednesday to serious assault of a person over 60.

Police prosecutor Senior Constable Lewis Butterfield said the building manager of a Surfers Paradise complex went to the garage after hearing something hit the roller door on October 19 last year.

He said the manager saw Schubert parking a ute and he went to talk to the passenger.

The court was told Schubert got out and tried to get to the building manager but his passenger stood in between the pair.

Sen Const Butterfield said Schubert got around his friend and kicked and punched at the building manager, making “minor contact” with his face.

Defence lawyer Joe Wicking, of Howden Saggers Lawyers, said there was a “level of provocation” as Schubert and a number of other residents had ongoing issues with the building manager.

“This building manager has made life very difficult for a number of residents,” he said.

“His actions caused distress to local residents.”

Mr Wicking said Schubert’s ute had only clipped the roller door.

He said the building manager approached Schubert in an aggressive manner.

“It is in part due to a fairly strained relationship between my client and the building manager – there is a very difficult and strained relationship behind it,” he said.

Mr Wicking said Schubert had lost his job as a chef due to the coronavirus pandemic.

Magistrate Joan White fined Schubert $650. No conviction was recorded.
