Two police officers, Zachary Samuel Maidment and Todd David, are alleged to have been at the party as well. Both Rapid Action Parol officer face multiple drug related charges including possession of cocaine and MDMA. Maidment has also been charged with supplying drugs, permitting use of place, possessing property suspected of being used in relation to a crime and possessing anything used in the commission of a crime. Their matters are still before the courts.
Maidment’s ex-girlfriend Tyana Hansen, a stripper and star of the Ultra Tune advertisements, was fined $1500 last month for possessing dangerous drugs while at the party at the Darling Hotel.
Bernoth pleaded guilty on Tuesday to possessing anything used in a commission of a crime and two counts of possessing dangerous drugs.
He was placed on a $750 good behaviour bond for nine months and ordered to participate in a drug diversion course. No conviction was recorded.
Police prosecutor Sergeant Reece Foort said Bernoth was in a hotel room at the Darling Hotel which had been allegedly hired for Maidment’s birthday party.
Surveillance had been placed in the hotel room as part of an ongoing operation.
Sgt Foort said during the party Bernoth had been seen snorting cocaine from a woman’s buttocks, taking MDMA tablets and cutting cocaine into lines on a plate.
The court was told Bernoth asked an adult entertainer if she wanted to do a line of cocaine.
“You will have to put it in my nose, my hands are limey,” the woman replied.
Sgt Foort said the surveillance captured Bernoth helping the woman snort the drug.
The court was told a number of text messages were also found on Bernoth’s phone.
“I’ve got a bag of coke and some MD, should be a good night,” one text message said.
“Got two bags of coke, one at home,” another text said.
Magistrate Louisa Pink said the facts were “fairly significant”.
“Even putting aside your involvement with a police officer, putting that to one side, there is essentially an allegation of supplying an adult entertainer with cocaine and having messages on your phone confirming that you have been involved in the supply of drugs,” she said.
“The seriousness of those facts is not reflected in the charges against you.”
Defence lawyer Lewis Hunter, of Guest Lawyers, said Bernoth was remorseful for his actions.
“He is eager to complete the drug diversion program,” he said.
Mr Hunter said Bernoth was a mechanic and worked in the mining industry until he injured his shoulder.
Bernoth now works as a mechanic in Brisbane.
