The discharge of the murder charges comes a week after Magistrate McInnes also cleared their former co-accused Garry Brush of the murder charges.

The trio faced a committal hearing in the Southport Magistrates Court in January, charged with murder for the deaths of ex-Comanchero bikie Mr Ross and his Monstr Clothing business partner Mr Martin.

Brush, Miller and Singh are alleged to be members of the Lone Wolf bikie gang.

Mr Ross and Mr Martin were shot dead near Martin Shiels Park in Tallebudgera in October 2019.

Mr Martin was located deceased in his vehicle around 9.30pm on Friday October 18, 2019.

Three days later, 36-year-old Mr Ross was located deceased in bushland on the corner of the Pacific Highway and Tallebudgera Creek Rd.

The court had heard a key part of the case was that two cipher phones, named the red phone and the green phone, were in the vicinity when Mr Ross and Mr Martin were murdered.

Singh and Miller had allegedly been linked to a third phone.

Brush was alleged to have used a third phone to lure Mr Ross near the murder location.

The red phone was allegedly linked to Singh and the green phone allegedly linked to Miller.

Magistrate John McInnes said: “Whilst they have certainly not been excluded as possessors of the red and green phones on the evening of the 18th, the evidence is not in my view capable that each was in possession of those phones to the exclusion ofothers at those material times.

“Accordingly my duty, having found the evidence not sufficient, is to discharge Mr Miller and Mr Singh.”

Outside of court Miller’s lawyer Jason Grant, of Grant Lawyers, thanked the magistrate for taking the time to carefully consider the evidence.

Singh’s lawyer Danielle Heable, of Dib & Associates, declined to comment.

Brush is understood to have been released from custody.

Miller and Singh will remain behind bars on unrelated matters.
