A Gold Coast construction company has been fined more than $25,000 for failing to comply with attempts to back-pay two construction workers their entitlements.

Mac-Worx Pty Ltd were fined in the Federal Circuit and Family Court after it was found they did not take the steps ordered in a compliance notice relating to paying workers their outstanding entitlements after they were underpaid.

The underpayment had been investigated by the Australian Building and Construction Commission (ABCC) prior to its abolition.

They issued compliance notices in March and August last year ordering Mac-Worx to take steps to ensure the workers were provided with the correct pay.

Legal action was commenced.

In December last year the responsibility for the matter transferred from the ABCC to the Fair Work Ombudsman (FWO).

FWO Sandra Parker said failure to act on compliance notices not only often resulted in fines but also orders to back-pay workers.

“When compliance notices are not followed, legal action can be taken against employers to ensure workers receive their lawful entitlements,” Ms Parker said.

“Any employees with concerns about their pay or entitlements should contact us for free advice and assistance.”
