Les Ross, father of ex-Comanchero bikie Shane Ross ’shattered’ after murder charges dropped

A former Comanchero bikie was gunned down in a quiet Coast park two years ago. Now, his dad is “shattered” after a shock decision was made to drop murder charges against three men.

The father of an ex-bikie gunned down in a Gold Coast park two years ago says he will not stop being a “voice” for his dead son after the “shattering” decision to drop murder charges.

Les Ross, who is the father of ex-Comanchero bikie Shane Ross, says he is “shattered” the murder charges against three men were discharged in the Southport Magistrates Court on Friday.

He was also dumbfounded a single prosecutor was up against four experienced barristers.

Shane Ross and his Monstr Clothing business partner Cameron Martin were shot dead near Martin Shiels Park in Tallebudgera in October 2019.

Mr Martin was found in his vehicle around 9.30pm on Friday, October 18, 2019. Three days later, Mr Ross’s body was found in bushland on the corner of the Pacific Highway and Tallebudgera Creek Rd.

Nathan Miller, Brodie Singh and Garry Brush were all charged with the pair’s murder.

In January, a more than two-week committal hearing was told of Mr Ross’s movements leading up to his death.

On March 11, Magistrate John McInnes discharged Brush of the two murder charges.

A week later he did the same for Miller and Singh.

The court was told key evidence centred on secure cipher phones being in the hands of Miller and Singh at the time Mr Ross and Mr Martin were killed.

On Friday Magistrate McInnes said: “Whilst they have certainly not been excluded as possessors of the (cipher) phones on the evening of the 18th, the evidence is not in my view capable that each was in possession of those phones to the exclusion of others at those material times.”

It is uncommon for the Magistrates Court not to commit serious charges to trial.

When someone is discharged at committal police can only recharge them if new evidence becomes available.

The Department of Public Prosecution can choose to put an indictment forward in the Supreme Court.

The decision has baffled Les Ross who is still struggling to come to terms with the death of his son.

“Everybody is just shattered,” he told the Bulletin.

“The magistrate should have let the jury decide.

“I just can’t understand any of it.”

Mr Ross, who now lives in Sydney, was unable to attend the committal hearing as he was caring for his daughter who was sick and has a disability.

He said he wanted to “be a voice for his son” because Shane could not refute the allegations in court.

“It was all about my son because he used to be in the (Comancheros) club,” he said.

Mr Ross said Shane had not been part of the club for the four years before his death and was trying to turn his life around.

“That was my best mate. That was my boy,” he said.

He also refuted any suggestion Monstr Clothing was not above board.

“It was a legit business because my daughter and I went up there and packed orders,” he said.

During the committal hearing the court was told there was evidence that Shane Ross helped move 5kg of methamphetamine from Sydney into Queensland.

“Then why did he have to borrow $30,000 from Cameron to remove his brain tumour?,” Mr Ross said.

Mr Ross said Mr Martin was also supportive of him and his family when his wife died about five weeks before the two men’s deaths.

He said that since the committal he has spoken to detectives who told him that they felt like they “let him down”.

Mr Ross said he did not want to talk to the prosecutor.
