Ashley McGregor’s explanation for infant son’s fatal injuries to be reconstructed by police, court told

A father’s explanation about how his 21-day old baby sustained fatal injuries in a fall at home will be reconstructed, a court has heard.

Ashley John McGregor, 32, of Christie Downs appeared in the Adelaide Magistrates Court on Wednesday, charged with the manslaughter and criminal neglect of his infant son, Alvin.

Police were called to the Noarlunga Hospital on April 23 last year, after the baby arrived unresponsive and died. His death was then declared a major crime.

A prosecutor told the court the investigators required an adjournment for a further expert paediatric report, which was “likely to take some time”.

“It’s for an expert opinion on a reconstruction of the defendant’s evidence about how it played out,” the prosecutor said.

The court has previously heard Mr McGregor claims he tripped over a pet dog while holding the baby, causing him to fall into a bassinet.

McGregor told police he had been home alone with the child when he tripped.

“A coronial report from the medical examiner has come back that doesn’t concur with the defendant’s version of events,” the prosecutor said at the earlier hearing.

“It was found the injuries were inflicted and the child had extensive brain bleeding and fractured ribs.”

Andrew Williams, for Mr McGregor, said his client maintained his explanation about how the baby was injured.

“My client has told the police, told his partner about an accident to do with the child and doesn’t resile from that,” he said.

“The police say, well, that accident couldn’t have caused the injuries.”

The court heard a co-accused, the child’s mother, Rebecca Lea Denton, has also been charged with criminal neglect following the baby’s death.

Mr McGregor returns to court in August, when he is expected to enter pleas.
