Appeal against White Horses development on First Ave, Burleigh Heads, withdrawn

The Planning and Environment Court has been told about a major development in an appeal against twin towers planned for Burleigh.

AN appeal to stop towers being built in Burleigh near the proposed tram station has been withdrawn after behind the scenes negotiations.

Teacher Nikki McRedmond had applied to the Southport Planning and Environment Court stop the two 23-storey beachfront, luxury towers from being built on The Esplanade.

She had claimed the project will detract from the character of the area and the height was excessive.

Her lawyer Anthony Knox, of Hickey Lawyers, told the court on Friday it had been agreed to withdraw the appeal.

Judge David Kent agreed the appeal could be withdrawn.

“I congratulate the parties on resolving that one,” he said.

A GOLD Coast teacher is fighting to stop the development of two 23-storey beachfront, luxury towers claiming the project will detract from the character of the area.

The controversial development is just metres away from where the Burleigh Heads tram station will be built.

Nicole Lesley McRedmond has launched an appeal in the Planning and Environment Court at Southport against the White Horses development on First Ave, Burleigh Heads.

The hotel and apartment complex was approved by council in August this year.

When the development was lodged more than 250 objections were lodged.

More than 350 submissions in support were made.

It is the second time in less than a year that residents have launched legal action against a council approved project on First Ave.

The development by Nielson Properties Australasia and LGC Property Investment consists of two luxury towers, 77 permanent resident units and 132 units.

The project will also include two swimming pools, a cafe, gym, restaurant, function centre and bar.

In court documents filed by Hickey Lawyers on Ms McRedmond’s behalf, it is claimed the development is of “excessive height” and would not “protect the important elements of local character or scenic amenity”.

“The proposed development would dominate and detract from the local area’s visual amenity, neighbour identity and character,” the court documents said.

The documents claim the design of the towers does not protect the privacy of nearby residents and “does not make a positive contribution to the city image”.

The developers also failed to establish that the proposed development is in the public interest, the documents said.

Developments in the southern coastal areas of the Gold Coast have been controversial in recent months, with many residents saying the high rises are destroying a “village feel”.

In May, Burleigh Heads man Kenneth McIntyre launched an appeal in court against a 13 storey tower on First Ave.

A defence is expected to lodged in the coming weeks.
