A Logan man charged with raping a 16-year-old girl and stealing her wallet has told a court it was a case of mistaken identity.
Javad Hosseini, 27, applied for bail in Beenleigh Magistrates Court on July 4. He did not enter a plea.
He was charged with rape, assault occasioning bodily harm and robbery.
Police alleged that on June 30 in Woodridge, the 27-year-old Heathwood man raped a 16-year-old girl, who was not known to him, and stole her wallet
The court heard an alleged witness was at Mr Hosseini’s Woodridge home when he saw a female child staggering down the street.
The witness approached the 16-year-old girl and she allegedly said to him “I have been raped, I am bleeding, call police”, the court heard.
Police alleged CCTV footage showed Mr Hosseini walking alongside the alleged victim at FoodWorks on Ewing St, Woodridge, the day of the alleged attack, the court heard.
Defence lawyer Jason Phister said his client instructed that he does not know the complainant at all and it was a case of mistaken identity.
“He denies the allegations. There is no evidence in the bail affidavit he would interfere or obstruct with any witnesses,” Mr Phister said.
“He states he does not know the alleged victim at all.”
Magistrate Michael O’Driscoll denied bail and said a suitable address could not be obtained, which was a necessary condition before granting bail.
“The charges are serious and he is an unacceptable risk of committing further offences,” he said.
“The defendant is a known drug user and has a criminal history.”
The matter was adjourned to August 28 and a brief of evidence was ordered, due by August 15.
