A concreter hit a patron with a pool cue and threw billiard balls at him, and bit another man, in a wild brawl in a Gold Coast tavern.

He only stopped when he was punched and pinned to the ground by other drinkers.

Dylan Graham left his two victims bleeding after his “inexcusable” actions at the Varsity Lakes Tavern just after 5.30pm on February 9.

He also left behind him a number of broken glasses and smashed door.

One man needed two staples to his head to treat his injuries.

The 26-year-old narrowly escaped spending time in prison after he pleaded guilty in the Southport Magistrates Court on Thursday to two counts of assault occasioning bodily harm and one count of wilful damage.

CCTV footage played to the court showed Graham diving into a fight with the pool cue after his girlfriend was accidentally knocked to the ground.

Graham is then seen grabbing pool balls off the table and throwing them at another man.

The video then shows Graham being punched to the ground.
Customers held him on the ground to end the brawl.

While Graham was on the ground, he bit one of the men holding him.

No security guards were present.

Magistrate Mark Howden sentenced Graham to 18 months prison with immediate release on parole.

“Biting someone is an abhorrent thing to do,” he said.

“It is inexcusable and in this day and age can lead to all types of communicable diseases.”

Magistrate Howden said the only reason he granted Graham, who has a violent criminal history in Victoria, immediate parole was because he had recently undertaken an anger management course.

Graham was also fined $600, ordered to pay $500 in compensation to each victim and $900 for the damaged glass.

Defence solicitor Ashkan Tai, of Ashkan Tai Lawyers, said Graham did not start the fight but “he did go too far”.

He said Graham only reacted after his partner was knocked to the ground.

Mr Tai said since the incident Graham had attended anger management courses and a number of counselling sessions.

Graham’s partner is six months pregnant with his first child, the court was told.
