A MAN accused of shooting a teenager on the balcony of a Surfers Paradise hotel has been committed to stand trial.

Beau Andrew John Smith is alleged to have shot Hayden Miller in the arm while they were at the Tiki Hotel about 10.45pm on June 15, 2019.

It is alleged Smith was inside the room when he raised the gun to the window and shot at Mr Miller.

Mr Miller, who was celebrating his 18th birthday, was on the shared balcony outside Smith’s hotel room, the court was told.

Smith was committed to stand trial on Wednesday after a committal hearing in the Southport Magistrates Court.

Defence barrister Angus Edwards, instructed by Ashkan Tai Lawyers, consented to the committal.

The court was told during the committal that Smith allegedly pointed to himself when undercover police officers questioned him about the shooting.

The shotgun used did not contain lead and the shot was likely to have been made up of rock salt, the court was told.

The trial will take place in the Southport District Court in the coming months.

Mr Miller, who was celebrating his 18th birthday, was on the shared balcony outside Smith’s hotel room, the court was told.

It is alleged Smith put a shotgun out the window and shot Mr Miller without warning.

Mr Miller was left with a wound to his elbow.

Smith faced a committal hearing in the Southport Magistrates Court on Tuesday for one count of acts intending to maim.

An undercover police officer, who cannot be named for legal reasons, said that Smith told him he had been “dragged into two shootings” – “one at the Tiki Village”, pointing to himself.

Smith did not clarify whether he had meant he had pulled the trigger or if he was just there, the court was told.

The court was told undercover officers had been tasked to question Smith in relation to an alleged homicide.

Jack White said he and Mr Miller were on the shared balcony for two to three minutes talking near the window of Smith’s room.

He said he saw the gun appear in the window a “split second” before it was fired, hitting his friend on the elbow.

Mr White said Mr Miller turned to him and said “I’ve just been shot”.

“We were confused and we were looking at each other and he has a jacket on and you can see blood,” he said.

Mr White said he also saw orange sparks.

Mr Miller gave evidence to the court but said he could no longer remember anything from the night because of trauma.

He said he remembered getting his room key and his next memory was being in hospital.

The court was told that immediately following the incident Mr Miller had given police a detailed statement.

The committal hearing continues on Tuesday.
