Mongols bikie Harley Barbaro has been granted bail for his alleged involvement in the group bashing of a man outside a Helensvale gym.

Barbaro’s release from jail comes weeks before his partner, Hayley Webb, is due to give birth to the couple’s second child.

The bikie has spent 164 days in pre-sentence custody in the Arthur Gorrie Correctional Centre. Police allege he assaulted a Rebels gang member outside the Iron Asylum Gym on February 28.

Barbaro is facing one charge of assault occasioning bodily harm while in company (serious organised crime).

Barbaro appeared via videolink in Southport Magistrates Court on Monday for his bail application.

His lawyer Campbell MacCallum, of Moloney MacCallum Lawyers, argued the case against Barbaro was “weak” and noted the prosecution had made an offer last week to remove the circumstance of aggravation to the charge.

The prosecution maintained it had a “very strong” case against the bikie and said this offer had since been withdrawn.

Police opposed his bail, arguing he was a risk of reoffending.

Magistrate Janice Crawford noted Barbaro had already spent 164 days in pre-sentence custody and would start six months’ probation upon his release from jail.

“The defendant also has a young family who rely on him,” she said.

“I am satisfied that the defendant has shown cause and the conditions of bail can reduce the risk of reoffending to an acceptable level.”

Magistrate Crawford granted Barbaro bail on a number of conditions, including that he must live at his nominated address in Arundel, report to police every Tuesday and Thursday and not have any contact with his alleged co-offenders.

He was also ordered to be on curfew between the hours of 8pm and 5am, except if he is required to provide care or be in hospital for his pregnant partner.

Magistrate Crawford said she was satisfied Barbaro would comply with the conditions.

His matter was adjourned to December 7.
