A woman was allegedly sexually assaulted after blacking out while suffering a medical episode in an inner Sydney apartment when a man known to her came over to help her move.

A woman has been allegedly sexually assaulted while unconscious after suffering a seizure in a “horrific” ordeal in an inner-city apartment.

Police allege 27-year-old Kyaw San Niang sexually assaulted the 40-year-old woman after she suffered an epileptic seizure in an apartment on Mountain St in Ultimo on February 17.

Mr Niang did not leave his cell when the matter was briefly mentioned at Bankstown Local Court on Tuesday.

Bail was not applied for and the matter was adjourned to June 16 to be heard at the Downing Centre Local Court.

Detectives commenced an investigation in March and following extensive inquiries, arrested the Lakemba man at about 7.30am Monday.

He was taken to Campsie Police Station, where he was charged with aggravated sexual assault – victim with cognitive impairment.

Police say the alleged victim has not been formally diagnosed with epilepsy, but has been suffering from seizures, which she has been trying to manage with medication.

NSW Police Detective Dave El-Badawi told reporters the condition causes the woman to have blackouts.

“She doesn’t remember a lot of it as she suffers from a condition which causes her to blackout for a number of minutes,” he said.

“We will allege this man took advantage of her and attacked her.”

Mr El-Badawi said the pair were friends and he went to the woman’s apartment to help her move.

No one else was at the apartment at the time and police have a strong case against the alleged offender, he told media.

Mr El-Badawi said the woman was in a “vulnerable position” at the time of the alleged offending.

“To attack someone in this manner in their moment of need – when they should be calling for medical assistance – is horrific.”
