Disgraced former entertainment manager Titus Day has been photographed enjoying what is his first day of freedom after seven months in prison for embezzling $620,000 of pop singer Guy Sebastian’s earning.
Day appeared sombre as he sat on the porch of a two-storey Victorian-style mansion in Bondi
as he awaited the outcome of his appeal against his conviction that saw him last year jailed for two-and-a-half years.
The 49-year-old wore a sweater, tracksuit pants and sheepskin boots as he sat on a cane sofa.
Day was released from St Hellier’s Correctional Facility near Newcastle on Monday night, after he had a partial win in the NSW Court of Criminal Appeal.
He was informed of the development on Monday afternoon by his lawyer Lauren MacDougall, who said: “He was understandably very happy to receive the news.”
Day was snapped on the porch of his North Bondi home alongside his son and the family dog.
He retreated indoors shortly after the pictures were taken.
Day’s bail conditions state he must be of good behaviour, report to police daily, and that he not contact Sebastian or any witnesses from the trial.
He is also not to go within 100 metres of an international departure point.
The bail decision came after Day won one of his three grounds of appeal against his conviction for fraudulently embezzling from the Australian Idol’s music royalties, performances and ambassador payments over eight years.
Two other grounds of appeal are still being considered by a three-judge panel, who could acquit Day if he wins relating to question of whether he was a clerk or servant of Sebastian.
In a statement Sebastian made to Instagram in July, the singer said he was “grateful” for Day’s position behind bars and it meant he could finally close a “painful chapter” of his life.
Sebastian continued: “It was not only shocking but also heartbreaking to discover the depth of betrayal and dishonesty that I uncovered over these last four years”.
The famed singer called Day one of his “closest mates” before describing his hurt.
“None of this needed to happen. I tried everything I could on so many occasions to get honest explanations for what was missing,” he wrote.
“These requests were met with the most outrageous and unfounded accusations, designed to tarnish my reputation, and dissuade me from pursuing justice.”
In November, Judge Gartelmann sentenced Day to four years in jail with a two-year, six-month non-parole period.
He was also ordered to pay more than $620,000 in restitution to Sebastian.
The court heard the talent manager then failed to remit what was owed to the pop star from 2009 until November 2017, when the pair fell out.
