Guy Sebastian’s former manager Titus Day has had a partial win in his appeal against his conviction for ripping $620,000 off his pop star client.

Guy Sebastian’s former manager Titus Day will be released from jail after he had a partial win in his appeal against his conviction for ripping $620,000 off the pop star.
Day will be released from St Hellier’s Correctional Facility near Newcastle after being granted bail in the NSW Court of Criminal Appeal at 5.30pm on Monday.
It will then be up to the prison to process the application before he is released, which is expected to happen on Monday.
The 49-year-old was informed of the development this afternoon by his lawyer Lauren MacDougall.
“He was understandably very happy to receive the news,” Ms MacDougall said.
Day’s bail conditions state he must be of good behaviour, report to police daily, and that he not contact Sebastian or any witnesses from the trial. He is also not to go within 100 metres of an international departure point.
The bail decision came after Day won one of his three grounds of appeal against his conviction for embezzling more than $620,000, that his trial was told was fraudulently taken from the Australian Idol winner over eight years.
Two other grounds of appeal are still being considered by a three-judge panel in the NSW Court of Criminal Appeal.
Day is expected to be acquitted if he wins one of the remaining grounds of appeal, which relates to question of whether he was a clerk or servant of Sebastian.
Day was sentenced to a maximum 2½ years behind bars in November after being found guilty in the Sydney District Court.
The former manager’s lawyers successfully argued that the Crown Prosecutor’s closing address to the jury caused a miscarriage of justice.
This included a contention that the prosecutor argued that Day should be convicted because there was no explanation about why the money was not remitted to the pop star.
Day’s team also argued there were several other “unfair or misleading submissions” by the Crown that required “correction by the trial judge.”
On June 30, 2022, the jury found Day guilty and convicted him on 34 of 47 charges.
He was found not guilty of the remaining 13 charges.
In November, Judge Gartelmann sentenced Day to four years in jail with a two-year, six-month non-parole period.
He was also ordered to pay more than $620,000 in restitution to Mr Sebastian.
The court was told Day embezzled money from performances, including a tour with Taylor Swift and an ambassadorship with Dreamworld.
The trial was told payments for Sebastian’s performances were sent to trust accounts held by Day’s firm 6 Degrees. The court heard the talent manager then failed to remit what was owed to the pop star from 2009 until November 2017, when the pair fell out.
Day became Mr Sebastian’s manager in 2009 with the split occurring over the money.
