Dominic Struthers, 21, faced Wagga Local Court on Tuesday after police arrested and charged him on Monday with three counts of sexual intercourse with child aged 14 years or older and under 16 years of age.
Court documents reveal the alleged incident took place at Stanhope Gardens some time on Sunday October 4.
The court heard the complainant lives in Sydney and the pair were introduced through friends.
Struthers’ lawyer told the court he suffers from a brain injury which he suffered as a baby.
His lawyer told the court he was at “great risk in jail” and had “trouble understanding what is going on”.
The court also heard Struthers had no history of violence.
Magistrate Halburd granted Struthers bail with a number of conditions including not to go to Sydney unless for legal and medical reasons and ordered him not to drink alcohol.
Struthers did not enter a plea. He will appear in Blacktown Court at a later date.
