Brodie Antoniak refused bail a second time in Batemans Bay court

A man allegedly pulled his penis out to “urinate” in front of a primary school moments after an alleged joy ride in a stolen vehicle has made another bid for freedom.

A south coast man who was refused bail on January 9 after allegedly going for a drunken joy ride in a stolen vehicle before pulling out his penis in front of a primary school has had a second bid for freedom dashed in court.

Brodie Antoniak, 33, from Batemans Bay faced Local Court on Monday on charges of break and enter, steal motor vehicle, drive recklessly, drive with middle range PCA and behave in an offensive manner within view of a public place/school.

While Antoniak has still not entered a plea, his lawyer, Adam Sumbak said he is expected to “plead guilty to some of the charges” in his next court appearance.

Court documents state the alleged joy ride occurred on January 8 and started when Antoniak allegedly stole a car from a Tuross Head property.

After an alleged pit stop to urinate outside Mogo Public School, the joy ride ended after he was pulled over by highway patrol, allegedly blowing a reading of .132.

Antoniak reappeared in Batemans Bay Local Court via video link from the south coast Correctional Centre.

Mr Sumbak told Magistrate Doug Dick his client was “making another release application”.

“He hopes to be released from custody and would abide by strict conditions,” he said.

According to Magistrate Doug Dick, in order for a new release application to be granted, there would need to be “new reasoning” submitted.

“This has not happened,” he said.

Magistrate Dick refused the bail application.

“It’s not going to be made today and you are going to remain in custody,” he said.

Antoniak will return to Batemans Bay Local Court via video link on February 20, where he is expected to enter pleas to all charges.
