Brodie Antoniak refused bail in Batemans Bay court

A man allegedly pulled his penis out to ‘urinate’ in front of a primary school moments after an alleged joy ride in a stolen vehicle, a court has heard.

A south coast man who allegedly pulled his penis out to urinate in front of a primary school moments after an alleged drunken joyride in a stolen vehicle will remain behind bars on remand.

Brodie Antoniak, 33, from Batemans Bay faced Local Court on Monday on charges of break and enter, steal motor vehicle, drive recklessly, drive with middle range PCA and behave in an offensive manner within view of a public place/school.

He has not entered a plea.

Antoniak faces the charges only two years after he was involved in a Canberra shooting in May, 2021, the court heard.

Magistrate Doug Dick described the charges as “serious offences” during a bail application on Monday.

“This is an overwhelmingly strong prosecution case,” he said.

“You have a very violent history.”

Documents read to the court state Antoniak allegedly broke into a Tuross Head house before stealing work tools and car keys.

He then allegedly broke into the owner’s car before fleeing the residence towards Batemans Bay.

Court documents say Antoniak was allegedly speeding and driving recklessly.

The then alleged joy ride ended at Mogo Public School where witnesses claim he allegedly got his penis out after leaving the car.

Antoniak’s lawyer, Lisa Stone, said he was simply urinating near the school and did not get his genitals out with any ill intent.

“One person’s needing to relieve themselves on the side of the road is another person’s offensive behaviour,” she said.

Returning to the car, Antoniak allegedly continued to speed down the highway, before being pulled over by highway patrol.

He allegedly blew a reading of .132 during a breath test, and a registration check allegedly showed the car was stolen.

Antoniak was arrested and held in the Batemans Bay Police Station cells overnight.

Mrs Stone said Antoniak should be granted bail as he is “working hard to turn his life around”.

“He’s willing to comply with any condition of bail that the court would impose and he is willing to report daily,” she said.

“He does have matters in his past but he is making efforts to put his life back together.”

Magistrate Dick declined to grant bail due to Antoniak’s criminal history.

“He has a history of violence and reoffending,” he said.

“I’m not satisfied that bail should be granted and therefore, it is refused.”

Antoniak will return to Batemans Bay Local Court on January 16.
