Austin Lee Mohr: Catalina man claims video footage and ticket are not evidence he sped

A young speeder has slammed an officer as a liar in an explosive hearing where he also claimed video footage of his speeding was not evidence.

A magistrate has shut down a speeding P-plater who labelled the police officer who pulled him over as a “liar” who was “trying to get a conviction”.

Austin Lee Mohr, 20, from Catalina, also claimed video footage of the offence played was not evidence he sped, when he faced Batemans Bay Local Court on Friday, charged with driving more than 10km/h over the speed limit.

Self represented Mohr returned to court for the hearing on the matter, after previously pleading not guilty to the charge on April 25, where he went head to head with the magistrate, claiming there was no evidence he sped. 

Mohr made the same claims yet again within minutes in court on Friday, telling Magistrate Michael O’Brien, he simply wanted to “see any evidence”.

“Your honour, I don’t want to go back and forth, I just want to see evidence I sped,” Mohr said.

“You have seen evidence, you have seen the ticket,” Mr O’Brien replied.

“Nope, I have not seen any evidence,” Mohr said.

Mr O’Brien sighed, before informing the court the “video footage played today” would be more than enough evidence.

Mohr disagreed, noting any video footage would not pass as evidence, as he “did not speed”.

“I can’t seem to get through to Mr Mohr, so we will just proceed,” Mr O’Brien said.

Senior Constable Mitchell Davis, who pulled Mohr over on December 23 after he was caught going 81km/h in a 60 zone, was called to the stand, where he commentated over an in car video (ICV) of the offence.

The ICV showcased Mohr speeding through a construction zone on the Princes Hwy south of Batemans Bay in the early hours of the morning, before Mr Davis pulled him over.

Another video was played to the court, showcasing the radar gun displaying “81”, however, Mohr informed the court he could not see the number, before slamming Mr Davis as a “liar”.

“Officers like you are liars who try to get a conviction, that’s what you’re doing,” Mohr said.

It was a comment which Mr O’Brien shot down immediately.

“Sir, that is an inappropriate comment and you cannot say that,” Mr O’Brien said.

“I have the privilege of having a screen right next to me and it does indeed say 81.”

After viewing the footage and reading the statement from Mr Davis, Mr O’Brien said it was “obvious” Mohr was speeding.

Mr O’Brien asked Mohr if he was aware of the safe drivers program before asking him if he would be willing to take the course, which teaches young drivers the perils of dangerous driving.

“No your honour, I don’t think I need to take that program,” Mohr said.

Mohr was found guilty of speeding, convicted and fined $100. No driving restrictions or licence suspensions were recorded for Mohr.
