Man sentenced to jail for sexual abuse of two stepdaughter and their friend

A stepfather who admitted to sexually abusing his two young stepdaughters and one of their friends has been sentenced. Read what happened in court.

A court has heard a man who waited for his partner to leave before sexually abusing his two young stepdaughters, and on one occasion sexually touching a friend that came over to the house, was “opportunistic”.

The now 38-year-old, who cannot be named for legal reasons, was sentenced in Newcastle District Court on Friday to five years in jail, with a non-parole period of three years.

He pleaded guilty to four charges of child sex abuse including indecent assault of a person under 16, two counts of intentionally sexually touching a person aged between 10-16, and sexual intercourse with a child between 10-16.

The court heard the incidents involving the three victims dated back to 2016 when he was aged 31 to 36 years of age, before he was charged in 2021.

A summary of facts read in court said on one occasion the stepfather was riding a motorbike with his stepdaughter, aged 15 at the time, before he started rubbing her genital area for around five minutes.

Another time, when his partner was out, he came up behind his other stepdaughter, aged 12 at the time, and pulled her pants down before rubbing his penis on her.

The court heard the 38-year-old also touched a friend of his step-daughter, who had come over to the house, by grabbing and pinching her on the buttocks.

Judge Roy Ellis described the offences as “opportunistic” and despite guilty pleas mid last year, he took some time before he accepted responsibility for his actions.

He read a statement from the offender which said he had realised the fault was his alone.

“I’m sorry what I did to the victims, I have a greater understand now than when I committed the offences. I am very sorry for what I did and wish it did not happen,” Judge Ellis read out.

“He does have reasonable prospects but I don’t think I could put them any higher than that.”

While an apprehended violence order (AVO) was already in place for the man’s two stepdaughters, Judge Ellis also granted a five year AVO for the third victim.

With time already served, the man is eligible for release in September next year.
