Kurt Marshall: Wilton man charged over Yagoona road rage incident

A man who allegedly struck a 66-year-old man in the head and smashed his car window with a metal pole has been identified in court.

A man who allegedly struck a 66-year-old man in the head and smashed his car window with a metal pole in a frightening road rage incident which ended in a police pursuit has been refused bail in court.

Kurt Anthony Marshall, 29, of Wilton appeared in Liverpool Local Court represented by Legal Aid lawyer Trajko Skopelja on charges of assault with intent to commit a serious indictable offence, armed with intent to commit an indictable offence, police pursuit, drive recklessly and drive while disqualified.

Police were alerted to a road rage incident at the intersection of Saltash St and Hume Hwy, Yagoona about 11.20am Tuesday by a member of the public.

They were told an unknown man, alleged to be Marshall, stopped a Subaru Forester in front of a Toyota RAV4, causing it to stop, before getting out and smashing a window of the Toyota with a metal pole.

He allegedly demanded money before striking a 66-year-old passenger to the head.

Police say when they arrived at the scene, Marshall allegedly fled the scene in the Subaru.

A pursuit was initiated but it was stopped almost immediately due to safety concerns. The 66-year-old man was taken to Bankstown Hospital with a head injury.

A short time later, police found the Subaru in the driveway of a Locker Ave, Lurnea home.

Marshall was then arrested and taken to Bankstown police station, where he was charged.

Mr Skopelja told the court Marshall had no record of violence and lives with his partner and child.

“In relation to the alleged assault, there appears to be no witnesses despite being broad daylight,” Mr Skopelja said. “The description of the victim’s vehicle has somehow come from a person on a crossing on the opposite side of the road.”

He offered a suite of bail conditions including that his client would not drive, would report daily to police, and not leave home unless accompanied by his partner.

Magistrate Imad Abdul-Karim said Marshall’s alleged actions put the lives of people on the road at risk.

“Having regard to the serious nature of allegations, and strength of the case, there is an unacceptable risk to the safety of the community,” Mr Abdul-Karim said.

“If convicted, he is likely to receive a custodial sentence.”

Marshall will next appear at Bankstown Local Court on October 5.
